In 1988, all of our school buildings were inspected for asbestos-containing materials according to the Asbestos Hazard Emergency Response Act (AHERA) protocol, using accredited inspectors. Based on the results, management plans were developed for each school identifying where asbestos was found. The plans and subsequent updates are available for review upon request by email health-safety@rpsmn.org or by calling the asbestos designated person at 612-798-6081.

AHERA compliance activities include annual notification of building occupants regarding asbestos­-related activities, periodic inspections, and repairs (every six months) and a complete re­inspect of all our buildings every three years to ensure that the materials are maintained in a safe condition. The six­ month periodic inspections typically occur during the winter and summer breaks when school is not in session.

This Management Plan for Lead-in-Water was developed to reduce the potential for exposure to lead in water and to comply with Minnesota Statute 121A.335, Lead in School Drinking Water. Lead is a metal that can enter drinking water through the distribution system, including pipes, solders, faucets, and valves. Exposure to lead is a significant health concern. While water is not typically the most prominent source of lead exposure for an individual, reducing lead in drinking water can help in lowering an individual’s overall exposure.

Minnesota Statute 121A.335 requires public school buildings serving pre-kindergarten and kindergarten through grade 12 to establish a plan to test for lead accurately and efficiently in water in potable water sources (water for consumption) every five years.  Richfield Public Schools has historically conducted and continues to conduct Lead in Drinking Water testing per the Minnesota Department of Health guidelines. If found, the District remediates lead levels following the Minnesota Department of Health guidelines and completes retesting prior to use.

Radon is a colorless, odorless, tasteless, radioactive gas that occurs naturally in soil, rocks, and underground water supplies and in the ambient air. According to the U.S. Environmental Protection Agency (EPA) and other scientific organizations, naturally occurring radon gas has been associated with an increased risk of developing lung cancer. The chances of developing lung cancer from radon exposure
are dependent on several factors including individual susceptibility and, perhaps more importantly, the dose and duration of exposure.

Radon testing in schools is highly recommended by the Minnesota Department of Health (MDH) and EPA. We follow MDH’s Guidance for Radon Testing in Minnesota Schools (4/08/2021) and ANSI/AARST "Protocol for Conducting Measurements of Radon and Radon Decay Products in Multifamily, Schools and Commercial and Multi-Use Buildings" (ANSI/AARST MA-MFLB 2023) and Minnesota Statute 123B.571.

We have developed and implemented an indoor air quality management plan that addresses indoor air quality issues throughout the District. Walkthroughs and inspections of the buildings are performed annually to detect current problems and prevent future problems from occurring. Additional information is available from the Minnesota Department of Health. We utilize Ecolab for our pest management. Ecolab is a licensed, professional pest control service firm for the prevention and control of rodents, insects and other pests in buildings. The Ecolab program consists of inspection/monitoring, maintenance recommendations and utilization of both non-­chemical measures and EPA­-registered pest control materials. Any chemical applications that are needed will be done after­ hours, when the areas being treated are unoccupied.

We utilize TruGreen for grounds fertilizing and weed control. The materials used are also registered by the EPA and applied according to the manufacturer’s recommendations. Treatment usually occurs on selected weekends during the months of May, June and September.

The long­-term health effects on children from the application of pest and weed control material are not fully understood. Parents and residents may request to receive, at their expense, prior notification of any application of a pest and weed control material, different from the days specified in the schedule. Please contact our Facilities staff at 612-798-­6066 with any questions or if you would like to receive prior notification of unscheduled treatments.

 

 

If you are the winning bidder on an item, here are instructions for payment and pick-up.

Payment

Public Processing, LLC, a third-party payment processing company, receives and processes all payments for Richfield ISD 280. Payment may only be made online by credit card or by wire transfer. NO CASH, CHECKS OR MONEY ORDERS WILL BE ACCEPTED! If you choose to pay with a credit card, please follow the instructions below. The credit card limit per transaction is $4,000. For payments larger than this amount, you will need to pay with a wire transfer (see below).

Sales Tax

Applicable sales tax 7.275% will be added to the amount due unless the buyer has provided a valid tax-exempt certificate to Richfield ISD 280 prior to payment.

Partial or Split Payments

There will be no partial payments allowed for an auction. All auctions must be paid in full by the specified payment process. For example, you will not be able to pay partially for an auction by credit card and pay the remainder by another payment method, such as a wire transfer.

Credit Cards

1. Login to the Public Surplus site.
2. Click on "My Stuff" and then click on "Past Bids."
3. Click on the description of the auction and then click the "Pay Online" link located on the right hand side of the screen.
4. Follow the steps to complete the transaction. A receipt will be emailed to you once the payment has cleared.

Wire Transfers

For payments over $4,000, a wire transfer is required. If you need to do a wire transfer, please email support at buyersupport@publicsurplus.com and ask for wire instructions or request the instructions via live chat. These instructions will be emailed to you. Please follow them exactly to allow for prompt payment. Wire transfer can take up to two business days to be received and posted. Do not attempt to pick-up your item until you have received notification that the wire transfer has been received.

Pick-Up Procedures

• You will be notified upon receipt of payment. You may then contact the responsible party listed for the auction item and arrange for a mutually convenient pick-up time. Be sure to bring the following items with you to the pick-up location. You must present all three identification items at the scheduled pick-up, or the auction item(s) will not be released to you.
  • Notice of award
  • Paid receipt
  • Personal identification (such as a driver’s license).
• If you are picking up an item for someone else, you will need all of the items listed above (photo copies are acceptable), plus a note from the designated “winning bidder” specifically naming you as authorized representative, along with your own identification. In addition, you must arrange for the winning bidder to send an email from the winning bidder’s email address used for the auction stating that you are authorized to pick-up the item.

Removal

Buyer must remove auction item(s) from the agency’s premises within ten (10) business days after the time and date of issuance of the Notice of Award. If the buyer, after making payment for an item, fails to remove the item within the specified time, the agency reserves the right to retain all payments and to dispose of the item through another auction or otherwise.

Successful bidders are responsible for packing, loading, removing and transporting of all property awarded to them from the place where the property is located as indicated on the website and in the Notice of Award. The buyer must make all arrangements and perform all work necessary, including packing, loading and transporting of the property. Under no circumstances will Richfield ISD 280 assume responsibility for packing, loading or transporting.

• Richfield ISD 280 may charge applicable sales tax 7.525%. The tax rate will be calculated at the time of bidding. When sales tax is included, the buyer shall add and include the sales tax amount when making payment.
• A Buyers Premium of 10% may be added to the final sale price with a $1 minimum charge per auction for payment collections. This premium, if applicable, will be visible during the bidding process and added to the total bid.
• All sales are final. Public Processing, LLC will notify buyer of receipt of payment via email.
• The successful bidder will be responsible for pick-up of item(s) from the agency’s premises. Pick-up must occur within ten (10) business days after notification of award.
• The notice of award, payment receipt and personal identification must be presented at time of pick-up, or the item will not be released.
• Pick-up hours by appointment only.
• The successful bidder will be responsible for packing, and/or loading any item(s) at pick-up, if necessary.

Contract. An award of sale is a contract between the winning bidder and Richfield ISD 280 upon the terms and conditions set forth herein. Richfield ISD 280 may pursue all legal remedies allowed by law against any bidder who fails to make payment for a winning bid.

Guarantee Waiver. All property is offered for sale as-is, where-is. Richfield ISD 280 makes no warranty, guaranty or representation of any kind, expressed or implied, as to the condition, usability, value, merchantability, authenticity, or fitness for any purpose of the property offered for sale. Some or all items may have been declared unsafe in their present condition by a federal or state safety standard. Buyers should inspect and, if necessary, repair/test all items prior to any use. Buyer is not entitled to any payment for loss of profit or any other money damages, including but not limited to special, direct, indirect, or consequential damages.

No Description Warranty. Richfield ISD 280 is not responsible for any omissions or errors in description of items being offered for sale. It shall be the bidder's responsibility to inspect and satisfy him or herself as to the details and conditions of the item offered before entering a bid. The Agency does not attest to the authenticity of any item.

Inspection. Most items offered for sale are used and may contain defects not immediately detectable. Bidders may inspect the property prior to bidding. Bidders must adhere to the inspection dates and times indicated in the item description or contact the person listed to schedule an inspection.

Indemnification. Bidder agrees for and on behalf of bidder, bidder's heirs, successors and assigns that bidder shall indemnify and hold Richfield ISD280 harmless from and against any claim, demand or cause of action arising or alleged to have arisen out of the sale or failure to sell any item of surplus property including claims for personal or bodily injury, death or contract damages.

Consideration of Bid. Richfield ISD 280 reserves the right to reject any and all bids and to withdraw from sale any of the items listed before a notice of award is delivered.

Reserve Requirement. If there is a reserve requirement and the reserve price is not met by the close of bidding, Richfield ISD 280 reserves the right to sell the auction item to the next highest bidder, relist the item for auction, or otherwise dispose of the item at Richfield ISD 280’s discretion.

Notice of Award. Successful bidders will receive a Notice of Award by email from PublicSurplus.com

Shipping. We cannot ship any item(s). However, you may contact a local carrier of your choice to pick-up, package, and ship your item(s) for you. It will be your responsibility to follow the Third-Party Pick-Up Procedures above to ensure that your item is released.

Bid Deposits. Richfield ISD 280 may require bid deposits in order to ensure fairness to all bidders. The deposit will be reversed if no default occurs or the bidder does not win the auction. The deposit will be retained if the winning bidder defaults.

Buyer Premium. A Buyer Premium of 10% will be added to the final sale price with a $1 minimum charge per auction to collect payment. The premium will be visible during the bidding process and will be included in the payment required.

State/Local Sales and/or Use Tax. Richfield ISD 280 may collect sales tax 7.275%, unless the Buyer has provided a valid tax-exempt certificate to Richfield ISD280 prior to payment. If applicable, the sales tax will be visible during the bidding process and will be included in the payment specified.

Removal. Buyer must remove auction item(s) from the agency premises within ten (10) business days after the time and date of issuance of the Notice of Award. If the Buyer, after making payment for an item, fails to remove the item within the specified time, the agency reserves the right (1) to retain all payments; and (2) to dispose of the item through another auction or otherwise. Successful bidders are responsible for packing, loading, removing and transporting all property awarded to them from the place where the property is located as indicated on the website and in the Notice of Award. The Buyer must make all arrangements and perform all work necessary, including packing, loading and transportation of the property. Under no circumstances will Richfield ISD 280 assume responsibility for packing, loading or transporting auction item(s). Buyer shall be liable to and reimburse Richfield ISD 280 for any damage to Richfield ISD 280’s property caused by Buyer’s or Buyer Agent’s removal of auction item(s) from the premises. No maintenance may be performed on Richfield ISD 280 property. For additional information, please contact the Director of Facilities & Transportation at Richfield Public Schools.

Abandonment of Item. Auction items paid for but not picked up within the specified time will be stored for 15 days from the last date of available pickup. Richfield ISD 280 will charge a storage fee of 10$ per day during this time, which must be paid by Buyer before the item will be released. At the expiration of the 15 day period, the item will be deemed abandoned and may be auctioned again to pay the storage fee. Any amount received in excess of the storage fee will be retained by Richfield ISD 280 as payment for additional efforts to dispose of the item.

Risk of Loss. In the event an auction item is lost or destroyed after a notice of award has been sent but prior to removal, and to the extent such loss or destruction is not caused by the buyer, or buyer’s agent or employee, Richfield ISD 280 will refund any money paid. The liability of Richfield ISD 280 shall not exceed the actual purchase price of the property.

Vehicle Titles. Richfield ISD 280 will issue a title or certificate upon receipt of payment. Titles may be subject to any restrictions as indicated in the item description on the website. Open titles cannot be issued. Richfield ISD 280 will not issue replacement titles.

Default. Default shall include (1) failure to observe these terms and conditions; (2) failure to make good and timely payment; or (3) failure to remove all items within the specified time. Default may result in termination of the bid contract and suspension from participation in all future sales until the default has been cured. If the Buyer fails in the performance of their obligations, Richfield ISD 280 may retain Buyer’s bid deposit and exercise such rights and pursue such remedies as are provided by law.

Acceptance of Terms and Conditions. By submitting a bid, the bidder agrees that the bidder has read, fully understood, and accepted these Terms and Conditions of Online Sales, and agrees to pay for and remove the property, if the bid is accepted, by the dates and times specified.
